Dec. 1, 2007, LexisNexis Expert Commentaries

In 2007, the Federal Circuit affirmed a judgment refusing to invalidate patents on aviation terrain warning systems under the public use bar of 35 U.S.C. Section 102(b), agreeing with the court below that the use at issue was a non-invalidating, experimental use. With this ruling, John A. Fischer explores the public use/experimental use distinction relied upon by the Court and offers guidelines for practitioners advising clients concerning the best practices to implement during the invention development process to reduce the risk that a patent may be invalidated under the public use bar.
