Q: Is smoking marijuana legal in Ohio now?

A: No! Smoking marijuana is still ILLEGAL in Ohio.

There has been much discussion over the legalization of marijuana all across the United States. Although Ohio enacted a medical marijuana law last year, that law has not yet been fully implemented. Furthermore, Ohio’s medical marijuana law does not permit smoking marijuana or any recreational use of the drug. I still see many new clients charged with possession of marijuana and marijuana paraphernalia.

Additionally, people who are on probation or pending a criminal charge should not smoke marijuana. In these situations, you may be subject to drug testing at any time. If a court gives you a drug test and you come up positive for marijuana, there is a good chance you will go to jail.

It also important to know that if you are pulled over by a police officer in a traffic stop, and a police officer smells marijuana, the officer will likely search your vehicle and may charge you with Operating a Vehicle Under the Influence of an Illegal Drug (OVI).
